### IMPORTANT – READ CAREFULLY

By selecting “yes” at the time of registration you are agreeing to the following terms and conditions of your participation in the 2026 ALS Rally. As the Participant you acknowledge that you are **waiving certain legal rights**, including the right to sue the Event organizers and other released parties. If you do not understand this document, you should **seek legal advice before signing**.

Participation in the ALS Rally is **voluntary**, and participation is conditioned upon execution of this Agreement.

Definitions

For the purposes of this Agreement:

**“Event”** includes the ALS Rally and any associated activities, including but not limited to:

• Driving segments
• Organized routes
• Social gatherings
• Hospitality events
• Vehicle displays
• Meetups, staging areas, and parking
• Launch points and finish locations
• Any related travel or activities organized, promoted, or suggested by ALS Rally

**“Released Parties”** includes:

ALS Rally, Event organizers, directors, owners, and promoters, Event staff and volunteers, Sponsors and partners, Marketing partners, Venue owners and property managers, Municipalities and public agencies involved in permitting, Contractors and service providers, Any affiliated companies or organizations, All respective officers, employees, representatives, agents, successors, and assigns.

Acknowledgment and Assumption of Risk

I acknowledge that participation in the Event involves **significant inherent risks**, including risks that may result in **serious bodily injury, permanent disability, property damage, or death**.

These risks include, but are not limited to: Operation of high-performance or modified motor vehicles, Driving on public or private roadways, High speeds or spirited driving, Mechanical failure of vehicles, Tire failure or blowouts, Vehicle collisions, Driver error, Negligence of other drivers, Actions of spectators or pedestrians, Animals or wildlife entering roadways, Changing road conditions, Weather hazards, Debris or obstacles on roadways, Limited visibility, Navigation errors, Fatigue, Alcohol consumption by participants or others, Theft or vandalism of vehicles, Damage occurring at hotels, restaurants, parking areas, or event venues, Risks associated with travel to and from Event locations

I further acknowledge that:

• The Event **may involve large groups of vehicles**
• Participants may drive **expensive or high-performance vehicles**
• Driving conditions may change unpredictably

Emergency services may not be immediately available

I **fully and voluntarily assume all risks**, both known and unknown, even if arising from negligence.

Participant Conduct and Responsibilities

I agree that:

• I will **obey all traffic laws and regulations**
• I will operate my vehicle **safely and responsibly**
• I will not engage in racing, street racing, or dangerous driving
• I will not drive under the influence of alcohol, drugs, or impairing substances
• I will follow all Event rules and instructions
• I will treat other participants, spectators, and venues with respect
• I will immediately cease participation if directed by Event organizers
• Event organizers reserve the right to **remove any participant for unsafe conduct**.

Vehicle Condition and Insurance

I acknowledge that:

• My vehicle is **properly registered and insured**
• I possess a **valid driver’s license**
• My vehicle is **mechanically safe and roadworthy**
• The Event organizers **do not inspect vehicles**
• The Event organizers **make no representations about vehicle safety**

I accept full responsibility for:

• Mechanical condition of my vehicle
• Insurance coverage
• Damage caused by my vehicle

Release of Liability

To the **maximum extent permitted by law**, I hereby release, waive, and forever discharge the Released Parties from any and all liability for:

• Personal injury
• Death
• Emotional distress
• Property damage
• Vehicle damage
• Loss of income
• Loss of use
• Any other damages
• arising out of or related to my participation in the Event.

This release applies **even if such injury or damage results from negligence**.

Covenant Not to Sue

I agree that neither I, nor my heirs, nor anyone acting on my behalf, will bring any claim, lawsuit, or legal proceeding against the Released Parties relating to the Event.

If such claim is brought, I agree to **indemnify the Released Parties for all resulting legal costs**.

Indemnification

I agree to **indemnify, defend, and hold harmless** the Released Parties from any claims arising out of:

• My actions
• My driving
• My vehicle
• My guests or passengers
• Any violation of law

This includes claims brought by:

• Other participants
• Spectators
• Passengers
• Venue operators
• Government authorities
• Third parties

Damage to Venues or Property

I accept full responsibility for any damage caused by me or my vehicle to:

• Hotels
• Restaurants
• Private properties
• Parking areas
• Public infrastructure
• Event venues

Alcohol and Controlled Substances

I acknowledge that:

• Alcohol may be served at certain Event venues
• I am solely responsible for ensuring I am **not impaired while driving**

Event organizers assume **no responsibility for participant alcohol consumption**.

Medical Authorization

In the event of injury or illness, I authorize Event organizers to obtain emergency medical assistance on my behalf.

I agree to be responsible for **all medical costs incurred**.

Media Release

I grant permission to ALS Rally and its partners to:

• Photograph or record me
• Use images of me or my vehicle
• Publish such content for marketing or promotional purposes

without compensation.

Event Modifications

I acknowledge that:

• Routes may change
• Venues may change
• Weather or safety issues may alter the Event
• Participation remains **at my own risk**.

Governing Law

This Agreement shall be governed by the **laws of the Province of British Columbia and the laws of Canada applicable therein**.

Severability

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain **fully enforceable**.

Entire Agreement

This Agreement constitutes the **entire agreement between the Participant and ALS Rally** relating to liability.

No oral statements modify this Agreement.

Acknowledgment

By signing below, I confirm that:

•  I have read this Agreement carefully
• I fully understand its terms
• I understand I am giving up legal rights
• By pressing “agree” I am agreeing to these conditions under my own free will
